visual studio 2010 - Is ILMerge broken when merging assemblies containing Lambdas in VS2010? -

I am trying to use ILMerge to merge assemblies in VS2010 and as a result the primary assembly is getting unusable is. It only appears when the conventions are merged, in which the Lambda expressions are. In addition, it seems to work fine in VS2008

I have underlined my investigation in more detail.

Any insights in how to solve this will be greatly appreciated.
